Is delta-8 legal?
Delta-8 is in a metaphorical legal haze. The 2018 Agriculture Improvement Act (also known as the 2018 Farm Bill) allows hemp to be grown in the United States and can be used in products all over the country. Hemp is a cannabis variety that contains less than 0.3% of THC.
The bill did not address the legality and use of delta-8. Delta-8 can be obtained from either hemp or marijuana plants, complicating matters. The only difference between these two sources is their THC content. Hemp is lower than the federal threshold (0.3%) while marijuana has a higher limit. The majority of delta-8 products that are sold today come from hemp sources.
